Terms of Service
These Terms of Service ("Terms") govern your use of the IJPB AI Pipeline Builder plugin and any associated cloud services (collectively, the "Service") provided by IJPB ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Use of the Service
IJPB grants you a limited, non-exclusive, non-transferable license to use the Service for your personal or institutional research purposes. You agree to use the Service only in ways that comply with applicable law and these Terms.
You may not:
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Resell, sublicense, or redistribute the Service without our prior written consent.
- Use the Service to build a competing product or service.
- Attempt to gain unauthorized access to our systems or another user's account.
- Use the Service in any way that could damage, disable, or impair our infrastructure.
2. Accounts and API Keys
Some features of the Service require you to provide a third-party API key (e.g., OpenAI, Anthropic) or to register for a cloud subscription. You are solely responsible for maintaining the confidentiality of your credentials and any activity that occurs under your account. Notify us immediately at buswinka@gmail.com if you suspect unauthorized use.
3. Cloud Subscription and Billing
The cloud subscription ("Cloud Plan") is billed on a monthly basis at the rate displayed on the pricing page at the time of purchase. All fees are non-refundable except as required by applicable law or as stated in our refund policy. We reserve the right to change pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.
Free-tier starter credits are provided as-is and may be modified or discontinued at any time without notice.
4. Data and Privacy
When you use the cloud features of the Service, image data and prompts you submit may be transmitted to our servers or to third-party AI providers to generate pipeline code. We do not permanently store your image data beyond what is required to process your request. Please review our Privacy Policy for full details on how we collect, use, and protect your data.
If you use the Service with your own API key and a local model (e.g., Ollama), your data is processed locally or through the provider you have configured, and is subject to that provider's terms and privacy practices.
5. Generated Output
The Service uses AI to generate ImageJ macros and Python scripts ("Generated Output"). Generated Output is provided for informational and convenience purposes only. You are responsible for reviewing, testing, and validating any Generated Output before relying on it in your research. We make no warranty that Generated Output is accurate, complete, or fit for any particular scientific purpose.
You retain ownership of Generated Output that you produce through the Service, subject to any applicable third-party AI provider terms.
6. Intellectual Property
The IJPB plugin, website, branding, and documentation are the intellectual property of IJPB and are protected by copyright and other applicable laws. Nothing in these Terms transfers any ownership rights to you. Feedback and suggestions you provide may be used by us to improve the Service without compensation to you.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by applicable law, IJPB and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or research outcomes, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless IJPB and its contributors from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Third-Party Services
The Service integrates with or enables use of third-party tools and services (e.g., OpenAI, Anthropic, Ollama, ImageJ, CellPose). Your use of those services is governed by their respective terms. We are not responsible for the availability, accuracy, or conduct of any third-party service.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service and cancel your subscription at any time. Sections 5 through 9 and 12 survive any termination.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which IJPB is registered, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of competent jurisdiction in that state.
